1
1. Acceptance and Authority
By registering, logging in, searching, making a reservation, using an API or otherwise using the Services, you confirm that you have authority to bind the business you represent and that you accept these Terms. If you do not accept them, you must not use the Services.
2
2. Nature of the Platform
Touric provides technology and distribution services that enable approved business users to access travel products and services made available by independent suppliers. Touric does not ordinarily own or operate the airline, hotel, transport, tour, visa, insurance or other underlying travel service. The supplier’s rules apply to each confirmed booking.
3
3. Partner Registration and Account
Provide complete and accurate business, contact, KYC and compliance information.
Keep registration information current and promptly notify Touric of material changes.
Use only authorized credentials and maintain the confidentiality of passwords, API keys and account access.
Accept responsibility for activity carried out through the Partner account, subject to applicable law.
Use the Platform only for legitimate business purposes and in accordance with applicable laws.
4
4. Permitted Use of Inventory
Touric inventory, content, availability and rates are supplied for authorized B2B use. A Partner must not copy, scrape, harvest, redistribute, reverse engineer or commercially exploit Touric content or supplier data outside the permissions granted by Touric.
Unless Touric expressly authorizes otherwise in writing, Partner access is intended for business-to-business distribution. Publishing Touric rates or inventory on an uncontrolled consumer-facing channel, or using the Platform to create a competing booking service without authorization, may result in suspension or termination.
5
5. Bookings and Supplier Rules
A booking becomes subject to the relevant supplier’s fare, rate, cancellation, amendment, identification, no-show, baggage, room, payment and other conditions once confirmed. Touric may assist the Partner in dealing with the supplier but cannot override supplier rules.
5.1 Air Travel
Passenger names and document information must be entered accurately.
Fare conditions, baggage allowances, reissue rules, cancellation charges and airline penalties apply as displayed or communicated.
Schedule changes, cancellations and operational disruptions are handled in accordance with the airline’s applicable procedures.
Any supplier-issued debit memo or equivalent charge attributable to Partner conduct may be recoverable from the Partner.
5.2 Hotels and Land Services
Hotel and land reservations remain subject to the property or supplier’s cancellation, amendment and no-show conditions.
Mandatory local taxes, resort fees, city taxes, deposits or other charges may be payable separately where specified.
Room type, bedding, location, early check-in, late check-out and special requests are not guaranteed unless confirmed.
Property descriptions, images, ratings, amenities and other supplier-provided information may change and are not independently guaranteed by Touric.
6
6. Group and Special Bookings
Suppliers may treat reservations involving multiple rooms, large passenger numbers or coordinated travel dates as group or special bookings. Where a supplier requires separate handling, Touric may require the Partner to submit the request through the designated offline or group process.
7
7. Prices, Currency and Payment
Rates and availability are dynamic and may change until a booking is successfully confirmed.
The currency and payment method shown at the time of confirmation will apply unless otherwise agreed in writing.
Applicable taxes, service charges, payment charges, supplier fees and local charges may be included or excluded depending on the displayed rate conditions.
A Partner must settle invoices and other amounts by the stated due date. Late or unpaid amounts may lead to account restrictions or recovery action.
8
8. Cards, Chargebacks and Payment Fraud
The Partner is responsible for ensuring that payment instruments used for bookings are authorized and legitimate. Where a chargeback, fraudulent payment, stolen card, unauthorized transaction or other payment abuse is attributable to the Partner or its customer, Touric may recover the resulting amounts, fees, penalties and reasonable costs to the extent permitted by law.
9
9. Cancellations and Refunds
Cancellation eligibility and refund amounts depend on the applicable supplier rules and the timing of the request. Where a supplier must first release funds to Touric, processing may take additional time.
Refunds will normally be returned through the payment method or account route permitted for the original transaction.
Some service, convenience, payment or mark-up components may be non-refundable.
No-show bookings may be non-refundable where the supplier applies a no-show charge.
Bank processing times, supplier delays and foreign-exchange differences may affect the final timing or amount.
10
10. Wallet, Credit and Advance Balances
Any wallet, deposit or credit facility is provided for use within the Touric Platform and is not a banking product.
Credit availability is subject to Touric approval, risk controls, payment history and applicable commercial terms.
Touric may apply available balances against unpaid invoices, penalties, supplier charges, chargebacks or other amounts owed.
Withdrawals or cash refunds of unused balances are subject to the applicable commercial arrangement and Touric approval.
11
11. Sanctions and Compliance
The Partner represents that it and, to the extent relevant, its owners, directors and authorized users are not knowingly using the Platform in violation of applicable sanctions, anti-money-laundering, anti-bribery, export-control or other mandatory requirements. Touric may refuse, suspend or cancel a transaction where required for legal, regulatory, risk or sanctions reasons.
12
12. Customer Data
The Partner must have the necessary rights, notices, permissions and lawful basis to submit traveler or customer information to Touric and its suppliers. The Partner remains responsible for the accuracy of information it submits and for handling customer requests in accordance with applicable privacy laws and its own privacy notice.
13
13. Prohibited Activities
Fraudulent, speculative, fictitious or abusive bookings.
Unauthorized scraping, automated extraction, reverse engineering or API misuse.
Attempting to bypass access controls, pricing rules, security mechanisms or account restrictions.
Uploading malicious code or using the Platform to distribute spam, unlawful material or harmful content.
Misuse of another user’s identity, credentials, payment instrument or personal information.
Infringing intellectual property or other rights belonging to Touric, suppliers or third parties.
14
14. Suspension and Termination
Touric may restrict, suspend or terminate access where reasonably necessary because of breach of these Terms, fraud, security concerns, non-payment, misuse, compliance issues, supplier requirements or conduct that creates material risk to Touric, its partners or other users. A Partner may request account closure, subject to settlement of outstanding obligations.
15
15. Third-Party Services and Links
The Platform may connect to supplier systems and third-party websites. Touric is not responsible for independent third-party content, policies, outages or services except to the extent responsibility cannot lawfully be excluded.
16
16. Intellectual Property
The Touric name, website, software, interfaces, documentation, content and other proprietary materials are owned by or licensed to Touric and are protected by applicable intellectual-property laws. No ownership rights are transferred to the Partner by use of the Services.
17
17. Availability and Disclaimer
The Services are provided on an availability basis. Touric does not promise that every feature, supplier, rate, route, property or service will always be available. To the maximum extent permitted by law, Touric disclaims warranties not expressly stated in these Terms, including implied warranties of fitness, merchantability, uninterrupted availability and error-free operation.
18
18. Limitation of Liability
To the maximum extent permitted by applicable law, Touric will not be liable for indirect, special, incidental, consequential or loss-of-profit damages arising from use of the Platform or a third-party travel service. Touric’s liability for a particular booking or claim will, unless otherwise required by law or agreed in writing, be limited to the amount actually received by Touric for the affected transaction.
19
19. Indemnity
The Partner agrees, to the extent permitted by law, to protect and reimburse Touric and its officers, employees and affiliates for reasonable losses, claims, penalties, costs and expenses arising from the Partner’s breach of these Terms, unlawful conduct, misuse of the Platform, payment abuse or failure to obtain required customer permissions.
20
20. Force Majeure
Neither party will be responsible for delay or failure caused by circumstances beyond reasonable control, including natural events, war, civil disturbance, terrorism, government measures, border restrictions, strikes, supplier failures, telecommunications outages, cyber incidents or other events that could not reasonably be prevented or overcome.
21
21. Independent Relationship
Touric and the Partner are independent contracting parties. These Terms do not create a partnership, employment relationship, agency, joint venture or franchise, and neither party may bind the other without prior written authority.
22
22. Dispute Resolution and Governing Law
These Terms are intended to be governed by the laws applicable in the Emirate of Dubai and the United Arab Emirates, as applicable. The parties will first attempt in good faith to resolve a dispute through commercial discussion. Where a dispute cannot be resolved, it will be subject to the competent courts of Dubai, United Arab Emirates, unless a separate written agreement between the parties requires arbitration or another dispute-resolution mechanism.
23
23. Changes to these Terms
Touric may revise these Terms when its Services, commercial arrangements, technology or legal requirements change. The current version published on the Website will apply to future use, subject to any mandatory notice or consent requirements.
